A federal judge in Northern California has rejected Elon Musk’s request for an injunction that could have perhaps stopped OpenAI’s intended shift to a for-profit entity, as reported by Bloomberg.
Musk did not provide sufficient proof necessary for an injunction,U.S. District Court Judge Yvonne Gonzalez Rogers determined on Tuesday. However, Rogers indicated that the court is ready to conduct a swift trial based solely on the assertion that OpenAI’s restructuring plan is unlawful, emphasizing that “irreparable damage occurs when public funds are utilized to support a nonprofit’s transition into a profit-driven association.”
This decision represents the latest development in Musk’s legal battle against OpenAI and its CEO Sam altman, who are accused of abandoning their original nonprofit goal of making AI research accessible to everyone.
Just a few weeks ago,Musk made an unsolicited offer to acquire OpenAI for $97.4 billion, which was met with unanimous rejection from OpenAI’s board. Nevertheless, this bid may create future challenges for OpenAI as it seeks to implement a more customary corporate framework.
